Terms of Service

COLLECT is operated by Collection Market LLC, a Florida limited liability company with its principal place of business at 4030 Henderson Blvd, Ste 564, Tampa, FL 33629 (“COLLECT”, “we”, “us”). By creating an account or using the site you agree to these terms. If you do not agree, do not use the service.

COLLECT is a venue. Items are listed, owned and sold by independent sellers, not by us. We are not the seller, the manufacturer, the grader, or a party to the sale contract between buyer and seller.

What we do provide is escrowed payment and an authentication step: the buyer’s payment is authorised and held rather than paid to the seller, the item is shipped to an authentication facility rather than to the buyer, and it only continues to the buyer if it passes. We are responsible for operating that process honestly. We are not responsible for the underlying qualities of any item beyond what the authentication check covers.

You must be at least 18 and legally able to enter contracts. You are responsible for the accuracy of your account information and for everything done through your account. Keep your password private and tell us promptly if you believe it has been compromised.

One person, one account, unless we agree otherwise in writing. We may suspend or close an account that we reasonably believe is fraudulent, is being used to launder funds, or is being used to circumvent these terms.

By listing an item you represent that:

• You own it outright and it is free of liens, disputes and third-party claims.
• You may lawfully sell it, and doing so infringes no one’s rights.
• Your description, photographs, grade, grading company and certification number are accurate. Photographs must be of the actual item, not a stock image or another copy.
• The item is not counterfeit, replica, reproduction, stolen, or altered without disclosure.

Prohibited listings include: counterfeit or unauthorised reproductions; stolen property; items you do not physically possess; items whose sale is restricted by law; and weapons and ammunition; items made from ivory or other protected wildlife; and products subject to a safety recall.

When your item sells you must ship it to the authentication facility within 5 days of the buyer’s payment, using the label or instructions we provide. If it has not shipped by then, the sale is cancelled automatically, the buyer is refunded and the listing is removed. Repeated failures to ship may result in account action.

A card is charged the full order total when you place your order, and COLLECT keeps the money until the item has passed authentication — the seller is not paid before then. If you pay in USDC, you instead authorise the amount from your own wallet and it is collected only when the item passes. If the item fails, is not shipped, or the order is cancelled before authentication, you are refunded in full, or the USDC authorisation is released — see the Refund Policy.

An accepted offer creates the same obligation to complete the purchase as a Buy Now order.

Every physical item is inspected by COLLECT’s own authentication team, typically within 3 business days of arrival. The check covers the item against the listing, its stated grade and its certification number. Items travel seller → COLLECT → buyer, and never directly between the two.

We inspect our own marketplace’s sales rather than using an independent authenticator, and we earn a commission only on completed sales. We disclose that plainly because it is a conflict a buyer is entitled to weigh. Every inspection is photographed and recorded against the order, and those records are what we rely on in any dispute.

A pass is an expert opinion, not a guarantee, and it does not transfer any grading company’s certification or warranty to you. A fail cancels the sale: the buyer is refunded in full and the item is returned to the seller at the seller’s expense. Repeated failures may result in account action.

Current fees, which we may change on notice:

• Seller commission — 9% of the item price, deducted from the payout.
• Buyer processing fee — 3% of the item price.
• Authentication fee — $15 per order, paid by the buyer.
• Shipping — $15 per order, paid by the buyer unless the seller has chosen to cover it, in which case it is deducted from their payout.
• NFT drops — sold by COLLECT at the price shown, in USDC. No separate service fee applies.

Fees are shown in full at checkout before you commit. Taxes are additional where applicable.

Risk of loss passes from the seller to COLLECT’s custody when the authentication facility takes delivery, and to the buyer when the carrier delivers the item to the buyer’s address.

You are responsible for insuring your shipment to the authentication facility for the item’s full sale price, and for filing any claim with the carrier. Loss or damage in transit to us is your responsibility to the extent it is not covered by insurance you purchased. Shipments from the authentication facility to the buyer are insured by COLLECT for the sale price. Sellers must pack adequately; damage caused by inadequate packing is the seller’s responsibility.

Seller payouts are handled by Stripe Connect and are subject to Stripe’s own terms. A payout is scheduled when the item passes authentication and released once the buyer has received it, less the seller commission. You must complete Stripe’s identity verification before you can be paid.

We may withhold or reverse a payout where an order is disputed, a chargeback is opened, or we reasonably suspect fraud, for as long as is necessary to resolve it.

The NFT section sells digital collectibles issued by COLLECT itself, priced and paid in USDC on Solana. They are a separate marketplace from physical items and work differently:

• Nothing there is authenticated, shipped or vaulted. You receive a token, not an object.
• Delivery is to the wallet attached to your account, through our checkout provider, and is recorded on a public blockchain. Transfers are irreversible: there are no returns.
• Buying one gives you the token and nothing else — no ownership of COLLECT, no revenue share, no promise of future value, and nothing on the site is investment advice.
• Digital assets are volatile and may become worthless or unsellable.

The Vault, Gacha and $COLLECT sections describe planned features. They are not available, nothing on those pages is an offer to sell anything, and $COLLECT is not a security, an investment, or a promise of future value or functionality.

Do not: transact off-platform to avoid fees; manipulate prices or bid on your own listings; use the site to launder money; scrape it at a scale that degrades it for others; attempt to access another account; or upload anything unlawful, infringing or malicious.

You may close your account at any time. We may suspend or terminate access for a breach of these terms, for suspected fraud, or where required by law. Obligations attached to open orders survive termination, as do clauses 14 to 17.

The service is provided “as is”. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted or error-free, nor that authentication will detect every possible defect or forgery.

To the fullest extent permitted by law, our total liability arising out of or relating to an order is limited to [THE ORDER TOTAL / OTHER CAP]. We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or lost data.

Some jurisdictions do not allow these limits, in which case they apply only as far as permitted.

You will indemnify COLLECT against claims arising from your listings, your items, your use of the service, or your breach of these terms.

These terms are governed by the laws of Florida, without regard to conflict of laws rules. Disputes will be resolved in [COURTS OR ARBITRATION — DECIDE WITH COUNSEL].[CLASS ACTION WAIVER — DECIDE WITH COUNSEL].

We may update these terms. Material changes will be notified by email or on the site before they take effect. Orders already placed are governed by the terms in force when they were placed.
