1Who we are
COLLECT is operated by [LEGAL ENTITY NAME], a [STATE] [ENTITY TYPE] with its principal place of business at [BUSINESS ADDRESS] (“COLLECT”, “we”, “us”). By creating an account or using the site you agree to these terms. If you do not agree, do not use the service.
2What COLLECT is — and is not
COLLECT is a venue. Items are listed, owned and sold by independent sellers, not by us. We are not the seller, the manufacturer, the grader, or a party to the sale contract between buyer and seller.
What we do provide is escrowed payment and an authentication step: the buyer’s payment is authorised and held rather than paid to the seller, the item is shipped to an authentication facility rather than to the buyer, and it only continues to the buyer if it passes. We are responsible for operating that process honestly. We are not responsible for the underlying qualities of any item beyond what the authentication check covers.
3Accounts
You must be at least 18 and legally able to enter contracts. You are responsible for the accuracy of your account information and for everything done through your account. Keep your password private and tell us promptly if you believe it has been compromised.
One person, one account, unless we agree otherwise in writing. We may suspend or close an account that we reasonably believe is fraudulent, is being used to launder funds, or is being used to circumvent these terms.
4Selling
By listing an item you represent that:
- You own it outright and it is free of liens, disputes and third-party claims.
- You may lawfully sell it, and doing so infringes no one’s rights.
- Your description, photographs, grade, grading company and certification number are accurate. Photographs must be of the actual item, not a stock image or another copy.
- The item is not counterfeit, replica, reproduction, stolen, or altered without disclosure.
Prohibited listings include: counterfeit or unauthorised reproductions; stolen property; items you do not physically possess; items whose sale is restricted by law; and [ANY OTHER PROHIBITED CATEGORIES].
When your item sells you must ship it to the authentication facility within [N] business days, using the label or instructions we provide. Failure to ship may result in cancellation, refund of the buyer, and fees or account action.
5Buying
Placing an order authorises a hold on your payment method for the full order total. Money is not taken at that moment. It is captured only when the item passes authentication. If the item fails, is not shipped, or the order is cancelled before authentication, the hold is released or refunded in full — see the Refund Policy.
An accepted offer creates the same obligation to complete the purchase as a Buy Now order.
6Authentication
Every physical item is inspected by COLLECT’s own authentication team, typically within 3 business days of arrival. The check covers the item against the listing, its stated grade and its certification number. Items travel seller → COLLECT → buyer, and never directly between the two.
We inspect our own marketplace’s sales rather than using an independent authenticator, and we earn a commission only on completed sales. We disclose that plainly because it is a conflict a buyer is entitled to weigh. Every inspection is photographed and recorded against the order, and those records are what we rely on in any dispute.
A pass is an expert opinion, not a guarantee, and it does not transfer any grading company’s certification or warranty to you. A fail cancels the sale: the buyer is refunded in full and the item is returned to the seller at [WHOSE] expense. Repeated failures may result in account action.
7Fees
Current fees, which we may change on notice:
- Seller commission — 9% of the item price, deducted from the payout.
- Buyer processing fee — 3% of the item price.
- Authentication fee — $15 per order, paid by the buyer.
- Shipping — $15 per order, paid by the buyer.
- Digital asset service fee — 2% of the asset price, minimum $0.99, maximum $250, charged separately from the asset itself.
Fees are shown in full at checkout before you commit. Taxes are additional where applicable.
8Shipping and risk of loss
Risk of loss passes from the seller to COLLECT’s custody when the authentication facility takes delivery, and to the buyer when the carrier delivers the item to the buyer’s address.
Items in transit are insured up to [INSURED AMOUNT]. Above that amount, [WHO BEARS THE LOSS]. Sellers must pack adequately; damage caused by inadequate packing is the seller’s responsibility.
9Payouts
Seller payouts are handled by Stripe Connect and are subject to Stripe’s own terms. A payout is scheduled when the item passes authentication and released once the buyer has received it, less the seller commission. You must complete Stripe’s identity verification before you can be paid.
We may withhold or reverse a payout where an order is disputed, a chargeback is opened, or we reasonably suspect fraud, for as long as is necessary to resolve it.
10Digital assets
The NFT section of the site aggregates listings from public marketplaces. Purchases there are fundamentally different from physical orders and you should treat them as such:
- Payment and delivery are handled by a third-party checkout provider. COLLECT never takes custody of the asset or those funds.
- Transfers are recorded on a public blockchain and are irreversible. There are no returns, and no authentication step applies.
- We do not verify, endorse or value any collection, and nothing on the site is investment advice.
- Digital assets are volatile and may become worthless or unsellable.
11Features that are not yet available
The Vault, Gacha and $COLLECT sections describe planned features. They are not available, nothing on those pages is an offer to sell anything, and $COLLECT is not a security, an investment, or a promise of future value or functionality.
12Prohibited conduct
Do not: transact off-platform to avoid fees; manipulate prices or bid on your own listings; use the site to launder money; scrape it at a scale that degrades it for others; attempt to access another account; or upload anything unlawful, infringing or malicious.
13Suspension and termination
You may close your account at any time. We may suspend or terminate access for a breach of these terms, for suspected fraud, or where required by law. Obligations attached to open orders survive termination, as do clauses 14 to 17.
14Disclaimers
The service is provided “as is”. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted or error-free, nor that authentication will detect every possible defect or forgery.
15Limitation of liability
To the fullest extent permitted by law, our total liability arising out of or relating to an order is limited to [THE ORDER TOTAL / OTHER CAP]. We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or lost data.
Some jurisdictions do not allow these limits, in which case they apply only as far as permitted.
16Indemnity
You will indemnify COLLECT against claims arising from your listings, your items, your use of the service, or your breach of these terms.
17Governing law and disputes
These terms are governed by the laws of [STATE], without regard to conflict of laws rules. Disputes will be resolved in [COURTS OR ARBITRATION — DECIDE WITH COUNSEL].[CLASS ACTION WAIVER — DECIDE WITH COUNSEL].
18Changes
We may update these terms. Material changes will be notified by email or on the site before they take effect. Orders already placed are governed by the terms in force when they were placed.
